Subsection 16(1) of the Code of Professional Conduct Regulation – Police Act reinforces the fact that every arbitration hearing is open to the public, therefore resulting in all evidence, including the identity of the police officer, being known to the public. Subsection 22(11) of the New Brunswick Police Act also states that any hearing shall be open to the public.
The Commission sought the expertise of the Office of the Access to Information and Privacy Commissioner, who confirmed that the decisions resulting from arbitrations can be published.
Therefore, to complement the Commission’s goal of education and to ensure that the complaint process is open and transparent, we are now publishing arbitration decisions which are listed below:
